TERMS OF SERVICE

Welcome to Lingullio.

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Lingullio ("Lingullio", "we", "our", or "us") governing your access to and use of our website, applications, learning platform, AI-powered tools, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.

1. Eligibility

You must be at least 18 years old, or have obtained permission from your parent or legal guardian if you are under the age required by applicable law.

You represent that you have the legal capacity to enter into this agreement.

2. Independent Educational Platform

Lingullio is an independent educational platform.

Lingullio is not affiliated with, endorsed by, sponsored by, approved by, or officially connected with any examination board, certification authority, university, governmental institution, or language organization unless expressly stated.

References to examinations such as HSK, HSKK, JLPT, TOPIK, TEF, TCF, IELTS, TOEFL, TOEIC or any other certification are made solely for descriptive purposes in order to identify the examination for which educational preparation is offered.

All trademarks remain the property of their respective owners.

3. Educational Purpose Only

The Platform is designed solely to provide educational resources, practice materials, AI-assisted learning, mock examinations and learning analytics.

Nothing on the Platform constitutes official examination material.

Practice questions, mock examinations and exercises are independently created by Lingullio unless expressly indicated otherwise.

4. No Guarantee of Certification Success

Although Lingullio aims to maximize your chances of success, we do not guarantee:

  • passing any examination;
  • obtaining any certification;
  • obtaining any minimum score;
  • admission to any institution;
  • employment opportunities.

Any estimated score, probability of success, AI prediction or learning recommendation is provided for informational purposes only and must not be interpreted as a guarantee.

5. User Account

You are responsible for:

  • maintaining the confidentiality of your credentials;
  • all activity performed under your account;
  • providing accurate information.

You agree to notify us immediately of any unauthorized use.

Lingullio is not responsible for losses resulting from your failure to secure your account.

6. License

Subject to compliance with these Terms, Lingullio grants you a limited, personal, non-exclusive, non-transferable and revocable license to access and use the Platform for your own educational purposes.

No ownership rights are transferred.

7. Intellectual Property

All content available on the Platform is protected by copyright and intellectual property laws, including but not limited to:

  • lessons;
  • AI prompts;
  • exercises;
  • examination simulations;
  • databases;
  • graphics;
  • videos;
  • illustrations;
  • software;
  • algorithms;
  • learning paths;
  • scoring systems;
  • progress analytics.

These materials remain the exclusive property of Lingullio or its licensors.

8. Strictly Prohibited Uses

Without our prior written consent, you may not:

  • copy Platform content;
  • reproduce lessons;
  • sell or redistribute materials;
  • publish screenshots of premium content;
  • create derivative works;
  • reverse engineer our software;
  • scrape any content;
  • use bots or automated tools;
  • circumvent security measures;
  • share your account;
  • resell access;
  • impersonate another user.

Violation may result in immediate termination without refund.

9. Artificial Intelligence Protection

You expressly agree that you shall not use any content available on the Platform for the purpose of:

  • training artificial intelligence models;
  • fine-tuning language models;
  • creating competing datasets;
  • building educational datasets;
  • developing competing products;
  • extracting prompts;
  • reproducing Lingullio's educational methodology.

This prohibition applies whether extraction is manual or automated.

10. Mock Examinations

Mock examinations are designed to simulate official examination conditions.

They are independently created educational materials.

Similarity of structure, timing or educational objectives with official examinations does not imply affiliation or authorization by any certification body.

11. Payments

Certain features require payment.

Prices are displayed before purchase.

Unless otherwise stated:

  • payments are processed securely by third-party payment providers;
  • access begins once payment has been successfully confirmed.

12. Refund Policy

Digital products may be refunded only under the conditions described in our Refund Policy.

Unless mandatory consumer protection laws provide otherwise, refund requests submitted after fourteen (14) days or after more than five (5) hours of cumulative use of the Platform will not be eligible.

13. Suspension and Termination

Lingullio may immediately suspend or permanently terminate any account in cases including, but not limited to:

  • fraud;
  • payment disputes;
  • account sharing;
  • scraping;
  • AI data extraction;
  • copyright infringement;
  • abusive behavior;
  • attempts to compromise Platform security.

Termination may occur without prior notice.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Lingullio shall not be liable for any indirect, incidental, consequential, special or punitive damages, including but not limited to:

  • examination failure;
  • lost profits;
  • business interruption;
  • data loss;
  • reputational damage;
  • missed educational opportunities.

Nothing in these Terms excludes liability where such exclusion is prohibited by applicable law.

15. Governing Law

These Terms shall be governed by the laws of France, without regard to conflict of law principles.

Where mandatory consumer protection laws of the user's country apply, those mandatory rights remain unaffected.
